Regulatory Update


Pennsylvania

PP&L has amended their default service plan, set to start on January 1, 2011, to include a portion of purchases from long term contract. Under the change, 5% of the default supply will come from 5-year contracts, and 5% will come from 10-year contracts. The revision to the plan also shortens the effective plan term from 41 months to 27 months.

Ohio

Duke Energy reached a settlement with the majority of interveners in their ESP case.  Under the terms of the settlement, average rates will increase 2% in 2009 and 2010 for residential customers, and 2% in 2009, 2010 and 2011 for commercial and industrial customers. The settlement preserves the current rate structure, including energy blocks and demand charges. The settlement still requires the approval of the Public Utilities Commission of Ohio.

New Jersey

The New Jersey Board of Public Utilities (BPU) has decided to keep the CIEP (hourly) threshold at 1,000 kW for the upcoming BGS Auction cycle. Customers under 1,000 kW will continue to have a fixed price service option from their utility. The BPU did repeal the minimum stay requirements for fixed price customers over 500 kW in demand. Current rules state that customers above 500 kW that return to fixed price service must remain for a minimum of 12 months.
